For MCAs who move parties within 180 days of an election, a High Court in Nakuru has ruled that Section 14 of the Political Parties Act is unconstitutional. To hear a petition filed by Kabazi MCA Dr. Peter Mbae, Chief Justice Martha Koome convened a three-judge bench consisting of justices Joel Ngugi, Hillary Chemitei, and Teresia Matheka.

The Nakuru High Court on Friday issued conservatory orders barring speakers of county assemblies from declaring a vacant seat for any county assembly member who has defected from one political party to another. Judge Joel Ngugi in his ruling, referred the case to Chief Justice Martha Koome to assign judges to hear and determine it.
