For MCAs who move parties within 180 days of an election, a High Court in Nakuru has ruled that Section 14 of the Political Parties Act is unconstitutional. To hear a petition filed by Kabazi MCA Dr. Peter Mbae, Chief Justice Martha Koome convened a three-judge bench consisting of justices Joel Ngugi, Hillary Chemitei, and Teresia Matheka.

The Nakuru High Court on Friday issued conservatory orders barring speakers of county assemblies from declaring a vacant seat for any county assembly member who has defected from one political party to another.
