Kenyans today are glued on their television sets following up proceedings in the Court of Appeal on the Building Bridges Initiative constitution amendment bill case pending it's final determination. This is after the high court ruled that the bill was unconditional, null and void. Justice Tuiyott has been the first judge uphold the High court's ruling on the electoral body IEBC's quorum in the practice of verification of the signatures in the bid to have a construction amendment initiated.
Seven judges who were selected to discuss the measure in-depth and render a final ruling are nearing completion of their work on the Building Bridges Initiative final judgment, which is likely to be revealed today. When it comes to President Uhuru and Raila Uhuru's initiative being passed, some judges like Justice Daniel Musinga and Justices Fatuma Sichale and Francis Tuiyott have expressed their professional opinions.
The BBI is on its dying bed as three judges out of the 7 judges standing with the decision of the high court to term it unconstitutional. Out of the 4 judges who have made their decision only Fatuma Sichale has dismissed the 5 bench high court ruling. Here are the ruling so safar;
The Court of Appeal is to make a rule by the end of the day concerning BBI. Out of six Judges that are to make their judgements, three of them have already. Justnce Francis Tuiyott, was the first one to make his judgement. However, he ruled against BBI; on the other hand, Justice Fatuma ruled in favour of BBI.
Justice Kairu said that the president Uhuru Kenyatta is not a Wanjiku thus not allowed by the Constitution to start a constitution amendments. He also said that the amendment was mostly done by executive than the people of Kenya. As things stand so far, the court of appeal is likely to uphold the Ruling made by High Court judges two months ago.
