Lawyer Danstan Omari has told Azimio only two things that can make the President-elect William Samoei Arap Ruto and the Deputy President elect Rigathi Gachagua not to be sworn in on 13th September, 2022 as demanded by the Constitution of Kenya. According to Danstan Omari, the Constitution requires that the President-elect and his Deputy will be sworn in since they have finished all the Constitutional requirements.

The Constitution of Kenya requires a general election to be held on the second Tuesday in August every fifth year, which means the next general election is scheduled for 9 August 2022. The Constitution requires that a presidential election take place at the same time as the general election.
