Raphael Kiplagat, a 38-year-old man was sentenced to life imprisonment on Thursday 29th September 2022 by Kabarnet Law court in Baringo after he forcefully slept with a 4-year-old girl in 2020.
Appearing before Judith Wanjala, the chief magistrate in Kabarnet law court, Kiplagat faced two court counts of willingly and forcing the girl into the act. Following the statement given by the prosecution side, the magistrate said that beyond a reasonable doubt, he committed the act and has to face the consequences.
The victim's brother also appeared in court as a witness and narrated how the old man took the young girl to a nearby farm where she had gone to fetch firewood, their parents had gone to church when the incident occurred. After the incident, the girl was rushed to hospital and the doctor confirmed that her hymen was broken after being exposed to the torture.
He pleaded not guilty and urged the magistrate to be lenient about detaining him since he has school-going children and his wife is just a casual labourer who can't make ends meet.
