The incident happened after 15-year-old girl claimed to have been assaulted and defiled by the officer. The girl was being held in custody at kiambu county at Gatundu police station before the officer took advantage of her. Her mother had given her to the police for care and protection.
The police constable was found guilty of the offence and a judgement made against him at that. The prosecution had 11 witnesses including IPOA investigators who presented enough evidence in court to arraign the police officer.
The acccused then was given a 40 years jail sentence after being found guilty since the magistrate said he found enough proof and beyond reasonable doubt to prosecute him.
