Judge Said Kitembwe feels that the laws on some serious offenses have to be looked into and other aspects considered before any decision is made by a court. He sited an example of the law on defilement.
Kitembwe, who was being interviewed by the Judicial Services Commission for the post of Chief Justice on Monday, said the law has to be amended to ensure that there is fairness.
The judge argued that regardless of the way any suspect who is said to have an affiar with an ndividual younger than 18 years, justice should be founded on the truth in the case.
"How would you send a 19-year-old to imprison for a very long time for having an affair with a 17-year-old young lady?" he inquired.
He additionally said that the court has a sole responsibility of protecting the rights of all citizens. Both the accused and the complainant have to get fairness in any court of law.
