3 Special People In Kenya That Cannot Be Arrested By Kenyan Police Or DCI

In the Republic of Kenya, there exists a category of special human beings who are protected by the Police Standing orders from any form of arrest or jurisdiction or even appearing in court as witnesses.

Nevertheless, this seems contrary to the authority given to Kenya Police and the Kenya Directorate of Criminal Investigations of maintaing law and order and making an arrest to anyone who breaks the laws governing our country.

Protecting members of the public, collecting and providing criminal intelligence, undertaking investigations on crimes, maintaining law and order are some of the core duties mandated to the Kenya Police and the Kenya DCI.However, the Kenya Police and DCI mainly work with orders and this now insinuates that they can't arrest anyone for breaking the laws as they are restricted by the Police Standing Order chapter 61.

The Police Standing Order Chapter 61 titled 'Relations With Diplomatic Corps in Kenya' outlines the following people as immune to arrest or any form of civil or criminal jurisdiction.1. The United Nations (UN) Agencies representatives cannot be arrested by the Kenyan authorities.

2. A diplomat and the family members of the diplomat are also immune to arrest.

3. A member of the technical or administrative staff of foreign mission cannot as well be arrested and they should not have a court proceedings against them.

However, not until when the stated special people above immunity is waived by their mission Head , their Government Head, these people cannot appear in court as accused persons or even as witnesses.
