Justice Daniel Musinga the president of Court of Appeal is tearing through BBI stating that creation of the office of Ombudsman as advocated by BBI aimed hindering Judicial Independence. “If a Presidential appointee is empowered to receive & investigate a complaint against judges, craft a motion of removal and present it to Judicial Service Commission. It is not difficult to discern that in making judicial pronouncements most judges will be cautious of going against the will of the President as he who pays the piper calls the tune.
Musinga has also said that BBI has no mandate to promise more constituencies saying that it purely lies with IEBC. This he says will advantage the yet to be leaders by giving them advantage over the other.
He has also Revealed that BBI was a project of Uhuru Kenyatta and Raila Odinga Rubishing off the claim that it was Junet's initiative.
The judge also points that the the Pro-BBI lawyers did not avail the required copies to all masses asking why MCAs were induced by giving them car Grants to facilitate the passage of the document.
