The Widely Awaited BBI judgment day is finally here with us. The court of appeal judges have been away for 50 days as they tried to deliberate on some of the issues were raised by the High Court a few months ago.
The High Court ruled that the BBI steering committee was unconstitutional and that nothing legitimate can come out of it. The court also declared that the President cannot initiate a constitution-making process under the current constitution.
Lawyer Steve Ogolla argues that the steering committee is unconstitutional since they did not follow the right process.
"The issue on the constitutionality of BBI steering committee turns on public participation; to establish a steering committee to perform such a momentous public interest function then there needed to be greater input on the appointment of the steering committee," he said
This meant that the BBI Reggae was temporarily stopped forcing the BBI Proponents to file an appeal at the appellate court. The High Court Judges had noted that the President can be sued in a personal capacity.
She also ruled that the President can be sued in a personal capacity.
