Shortly after Francis Wanderi resigned, there were reports that the last commisioner Irine Masit also resigned to become the last one out of the four who were suspended to quit.
However, her lawyer Donald B Kipkorir, has refuted the claims stating that the Embattled commissioner has not tendered any resignation letter.

"IEBC Irene Masit has given me firm instructions to quash her unconstitutional impeachment proceedings by Writ of Certiorari." He said
"We have already filed a Constitutional Petition in High Court, Nairobi. Any reports that she has resigned are the work of political brokers & idlers." He added.
So far Juliana Cherera, Justus Nyang’aya, and Francis Wanderi have resigned ahead of the official commencement of their investigation by the tribunal formed by President William Ruto.
Irine will be able to face the tribunal to defend herself and tell the tribunal what happened exactly during the August polls when they opposed chairman Wafula Chebukati's move to declare Ruto the winner.
