Tuesday saw the next beneficiary of the "freedom has come" wave when the taxman dropped a Sh2.2 billion tax evasion investigation against a significant ally of President William Ruto.
After the Kenya Revenue Authority requested that the Office of Director of Public Prosecutions (ODPP) grant the request to drop the corruption case against Mary Wambui's company, Purma Holdings, Mary Wambui, who is currently the Communication Authority of Kenya (CA) chairperson, was beaming in court.
While claiming to have reached an agreement with Wambui for the "payment of taxes established" last month, KRA failed to provide specifics.
The Tax Procedures Act, 2015's Section 109, which gives the taxman the authority to combine the fine a tax offender would have received with the original tax due, was mentioned by KRA Commissioner Paul Matuki. Only if the offender requests this process in writing and admits to the offense occurs.
The total sum she paid may never be known because the agreement between KRA and Wambui wasn't made public or disclosed in court.
"Dear DPP... the situation has worsened and the taxpayer has arranged a tax payment plan with the commissioner. Given the circumstances, we seek your office to enable the dismissal of the charges currently pending before the court in accordance with Section 204 of the Criminal Procedure Code." Mr. Matuki wrote in early December.
According to Ms. Sanga's letter, "the authority now wishes to withdraw the matter pending before court under Section 204 of the Criminal Procedure Code through the Investigating Officer following the successful compounding of offenses on December 6, 2022, and the subsequent payment of fines imposed."
Wambui had been charged with three counts of omitting from returns a sum that should have been included, failing to submit tax returns by the due date, and failing to pay tax by the due date, together with her daughter Purity Njoki Mungai and the business Purma Holdings Limited.
KRA claimed it lost Sh2.18 billion in taxes as a result of failing to include the Sh4.5 billion she earned after supplying multiple governmental organizations. The materials were produced from 2015 to 2019.
Wambui is not your typical female. She is referred to as "Wambui wa Ruto" in political circles, most likely because of her well-known strong relationships with the Head of State. She contributed significantly to the Jubilee Party's political campaigns at the same time.
