Garrisa Township Member of Parliament elect Hon Aden Duale has reacted after four commissioners of the Independent Electoral and Boundaries Commission declared that the presidential election results were marred by irregularities, especially during the final steps of tallying.
While taking to his social media platforms, the former National Assembly majority leader said that the decision of the 4 IEBC commisioners to stay away from the presidential election results announcement has no effect on President-elect William Ruto.
Duale said that the Constitution in article 138(10)(a) says that the IEBC chairperson is the only individual mandated to declare the presidential winner after 7 days of the presidential election.
He added the action of the 4 commissioners has no legal effect whatsoever. This comes after the country was treated with a surprise after the 4 commissioners distanced themselves from the election results claiming that the final process was opaque.
IEBC chairman Wafula Chebukati while announcing the results alleged that some commissioner were intimated while others are not known where they are. He however, went ahead and made the presidential announcement to the nation.
