Justice Fatuma Sichale Overturns High Court Ruling on the Basic Structure of the Constitution

According to justice Fatuma Sichale, the basic structure of the constitution can be changed. She is of the view that the current generation cannot be bound by the dead hands of the ancestors. Sichale opines that the basic structure of the constitution is not defined in the constitution.

According to Fatuma Sichale anything in the constitution can be changed by either a revolution or the people hence nobody should assume they can stop that. She has overturned the High Court of Kenya ruling which had affirmed that the basic structure of the constitution cannot be changed.

Sichale is of the view that constitutional changes is a matter political and therefore not a court process. She is of the view that the structure of the constitution can be changed at will by any generation at their own volition given the prevailing circumstances.

Fatuma Sichale has affirmed that no structure of the constitution that should remain rigid as it's a fact the people can make changes on anything. She has accused some judges who carry themselves as demi gods in a clear reference to the High Court of Kenya judges who nullified BBI report.
