High Court Declares A Law For MP And MCA To Have Degrees Unconstitutional

High court has declared today 15, October the law that demands Member of County Assembly, MCA and Member of parliament, MP to have degrees unconstitutional. This is a day after High Court declared Huduma Number rollout null, void and unconstitutional.

The court has ruled out the law that MCA and MP should have degrees from recognised institution as unconstitutional.

High Court Judge Anthony Mrima said the law is unfair and violated Article 10 (2)(a) of the constitution which requires public participation.

A declaration issued that section 22 (1)(b) of the election act is unconstitutional and in violation of Article 10 (2)(a) for failure to take public participation," said Justice Mrima.

The law states that a person is elected to hold an MP or MCA seat when he/she has degree from University.

Several politicians including deputy president were against the law as they said leadership doesn't come from Universities and anybody can lead peoples regardless of his level of education.
