With only a few months until the general elections, the leaders of the Hustler and Tangatanga factions have raised their concerns, accusing the judiciary of favoring one side of the political debate. Dr. William Ruto, the deputy president's United Democratic Alliance party secretary, has issued a special appeal ahead of the general election in 2022.
Koome's function as president of the Supreme Court, according to the United Democratic Party (UDA), poses a blatant conflict of interest because the chief justice is obligated by law to act as an arbitrator in election petitions.
The Technical Working Committee for Election Preparedness includes Chief Justice Koome.
UDA instructed Koome to 'henceforth stop, forsake, desist, refrain, and discontinue participating in the Committee's actions,' in a letter copied to Independent Electoral and Bounderies Commission, IEBC chairman Wafula Chebukati, head of the African Union commission, and the US embassy.
