More BBI Woes As Fourth Judge Rules Against The BBI on This Crucial Question About The Constitution

The BBI reggae was temporarily stopped after the High Court Judges ruled that the BBI was null and void. The High Court established that the President cannot initiate a constitution-making process under the current constitution. 

The judges also noted that the BBI steering committee was unconstitutional and that nothing legitimate can come out of it. 

This forced the BBI Proponents to go back to the drawing board where they decided to file an appeal at the higher Court. The court of appeal was expected to give its Verdict today after going for a 50-day retreat to write the final judgment. 

Apart from the BBI, the court of Appeal is expected to make a ruling on whether the president can be sued in a personal capacity. 

During the court of appeal Judgement reading, Court of Appeal Judge Justice Gatembi Kairu delivered a significant blow to the BBI team after he declared that the Basic structure doctrine is applicable in the Kenyan constitution. 

He also ruled that the President is not a Wanjiku and thus cannot initiate the process of amending the constitution in the current constitution.
