The Mombasa High Court denied a motion to withdraw a complaint attempting to prevent former Nairobi governor Mike Mbuvi Sоnkо from running for governor of Mombasa in the August 9 elections.
Justice John Mativo denied the petitioner's request to withdraw the petition on Tuesday, May 24, ruling that their plea did not meet the required conditions for the case to be dismissed.
Despite one of the petitioners withdrawing, Justice Mativo ordered that the case be heard.
"The court may proceed to hear the matter despite the petitioner's wishes to stop," the Judge ruled.
Ndro Kayuga intended to drop out of the case after learning that the former governor's impeachment was primarily political.
Mativo instructed, "The first petitioner is now entitled to withdraw from this petition and is swiftly dismissed from these proceedings."
