President Uhuru Kenyatta has once again suffered another blow in the Court after Justice Aantonny Mrima declared the move to appoint Nairobi Metropolitan Services Boss General Badi into his Cabinet, as unconstitutional null and void. The Mlimani law Court Judge said the move is not in accordance with the Constitution of Kenya.
Justice Antony Mrima ruled on a petition that was filed by Hon. Wahome gave out a warning order that stops Nairobi Metropolitan Service(NMS), General Badi, from preceding any Cabinet activity as already permitted by President Uhuru Kenyatta.
Hon. Wahome opposed the decision of Kenyatta to invite a stranger to sit in the Cabinet meetings and carry out Cabinet duties. Ms. Wahome in her petition said the move is contrary to the Constitution as the Constitution has stipulated well that members of the Cabinet and how they should be elected. The court said the decision to invite General Badi into the Cabinet is an idea they don't understand according to the Constitution of Kenya. hence declaring it unconstitutional, null and void.
"His position, role and mandate in the Cabinet is unknown or at least he respondents(Attorney General, secretary to the Cabinet and Major General Badi) chose not to disclose as such. It seems like the decision is masked in secrecy and therefore lacks transparency," said the Judge.
