The High Court last week ruled out that BBI bill is null and void. According to five judges who made this ruling, the BBI process did not follow they required procedures as stipulated by the Constitution of Kenya of 2010. According to BBI proponents, the BBI bill was a popular initiative, however, judges ruled that the bill was not brought through s popular initiative. Their ruling angered many people and political leaders who were hoping to amend the Constitution in order it expand the national Executive.
Government officials were also unhappy about the ruling. Some of them went public to express their angered and disagreement. For instance, Honourable Zack Kinuthia, who is the Chief Administrative Secretary in the education Ministry said that it's high for judges to be elected by voters. ".. Judges from the level of High Court must also also be elected by the people so that they are they can also accountable..." Honourable Zack Kinuthia said.
Honourable Zack Kinuthia has point but it may be unrealistic. If they will be elected by voters, when will they be elected? Is during the national election?. This is may be dangerous as some voters may elect a judge not because of integrity but tribal lines. What do you think about Honourable Zack Kinuthia's suggestion?
