Justice Anthony issued an order which ordered the IEBC from approving the nomination papers by Sonko to vie for governorship in Mombasa. Another file was presented to Chief Justice Martha Koome so that she can appoint judges to determine other petitions that were filled in Eldoret and Mombasa.
The petitioners who will also be vying for the seat claim that the impeachment of Sonko in December 2020 shows that he was guilty and is not qualified to stand any elective position according to the constitution.
The petitioners argued that Sonko was impeached from office after being in the high Court and the court of Appeal which shows he is guilty of misconduct and ineligible to vie for the seat or any position in the government.
