Azimio MP Ordered to Pay Ksh1B or Face Jail Term Over Corruption Scandal

John Waluke, a member of parliament (MP) for Sirisia, is facing 67 years in prison or a Ksh1 billion fine after being ordered by the court to do so.

Judge Esther Maina of the High Court dismissed Waluke's appeal against a judgment in which he was sentenced for a Ksh297 million scandal involving the National Cereals and Produce Board in her order on Thursday, October 6. (NCPB).

The MP will lose his seat and a subsequent by-election will be held to fill his seat if the fine is not paid.

A lawmaker could lose their seat if they are sentenced to at least six months in prison, as stated in Article 99 (2) (g) of the Constitution.

It should be noted that this only applies if the MP in question has exhausted all available avenues for appealing or reviewing the specific sentence.

After finding them guilty of committing fraud, Chief Magistrate Elizabeth Juma initially sentenced Waluke to 67 years in prison and his co-accused Grace Wakhungu to 69 years.

The two are still active directors of Erad Supplies and General Contractors, the parastatal accused of losing Ksh297 million in a shrewd deal involving the supply of white maize to NCPB.

The business was also charged with acquiring property worth Ksh13.3 million fraudulently. Waluke was consequently ordered by the Chief Magistrate to pay a Ksh726 million personal fine.

He would also be responsible for paying Ksh616 million of the company's fine. Juma explained that the severe penalties were intended to serve as a deterrent to those who would rather put Kenyans' lives in danger to advance their own agendas.

"The offenses are serious, and the accused individuals profited from the desperate circumstances in which maize was needed to prevent starvation among Kenyans. It necessitates a deterrence sentence, she decided.

Waluke, a lawmaker serving his fourth term, is currently free on a court-issued bond.
