Fresh Twist In Ruto's Assassination Letter As Dennis Itumbi Reveals The Following

Former state House Digital Director Dennis Itumbi while appearing before a Nairobi-based court where he had filed a petition to have all three charges against him dropped threw a twist in a case where he is accused of authoring a fake letter alleging an assassination plan against the Deputy President William Ruto.

Through his lawyer Katwa Kigen, Itumbi wants Milimani Chief Magistrate Martha Mutuku to find that he has no case to answer having earlier been charged with making false documents, publishing false documents and reprogramming a phone for lack of evidence.

Kigen argued that the prosecution did not make out a case in which the court can be interested in his defense." No credible, consistent and viable evidence and exhibits have been availed to assist or make a sufficient case for Itumbi to answer," he reiterated.

According to Lawyer Kigen, the charge of making a false document is unconstitutional following the landmark high court ruling in the case of blogger Cyprian Nyakundi with Itumbi further stating that deleting messages does not amount to reprogramming a phone as alleged by the court.

The court ruling is now expected on September 15, 2021, on whether there is a case to answer although the accused has refuted any involvement in writing a letter with an intention of fuelling anxiety.
