Do the Actions by the 4 the IEBC Commissioners on Monday Have Any Legal Effect? Duale Speaks

The action by the 4 Independent Electoral and Boundaries Commission (IEBC) Commisioners on Monday, 15th, ahead of Presidential result announcement by Chairman Wafula Chebukati to walk out of Bomas and hold a presser at Serena Hotel after disagreement has continued to trigger a series of debates.

Garissa Township Constituency MP Elect Aden Duale has weighed in to the debate of whether the action of the commissioners gave any legal effect.

Taking to his Twitter handle, Duale has stated that according to article 138(10)(a) of the Constitution, the Chairperson of the IEBC is to declare the results of the election 7 days after a Presidential Election.

He has stated that the Constitution mandates only the Chairperson of IEBC to declare Presidential Election Results.

Duale has said that the actions by the 4 Commissioners have therefore no legal effect whatsoever on the result announced on Monday evening.

"Like I have said before, the Constitution is always Speaking for those who care to listen to it.Freedom has loaded.God bless Kenya," Duale said.
