Noordin Haji, the Director of Public Prosecutions, has accused the National Cohesion and Integration Commission of exceeding its authority.
In a letter seen by the Star, Haji said that the NCIC lacks legal jurisdiction to overturn any decisions his agency takes regarding criminal charges.
Haji's decision to drop charges against Meru Senator Mithika Linturi, who had been charged of hate speech, had angered NCIC.
"You claim in paragraph 1 that withdrawing the application was a betrayal of the broader public. Please take note that the DPP is a guardian of public interest in criminal issues under Article 157(11) of the Constitution, as stated in the Decision to Charge Guidelines 2019, which were strictly followed "Haji remarked.
The NCIC, according to Haji, was attempting to stifle its independence by influencing its choices.
The DPP refuted NCIC's assertions that the withdrawal was part of a conspiracy to aid Linturi's evasion of justice.
