The High Court has temporarily held the import and distribution of genetically modified goods and commodities in the country.
The court also ordered an injunction blocking the government from implementing the Cabinet dispatch that lifted the GMO prohibition. It has been blocked from being lifted due to legal challenges.
Until the hearing and determination of this Application, the Court will issue an injunction and conservatory order prohibiting Respondents from publishing or acting on the contents of Dispatch from the Cabinet authored by the Executive Office of the President of Kenya.
"We respectfully request that, pending the hearing and determination of this Application, this Honorable Court issue an injunctive and conservatory Order restraining the Respondents herein from gazetting or acting upon the contents of Dispatch from the Cabinet authored by the Executive Office of the President of Kenya, dated 03 October 2022 Cabinet's Despatch on regarding genetically modified organisms (GMOs)." High Court said.

The difficult decision to allow the duty-free importation of 10 million bags of GMO maize over the next six months was announced by Trade Cabinet Secretary Moses Kuria on Thursday.
The CS has stated that he will publish a gazette notice authorizing the importation and that the government is prepared to bear the consequences of the decision.
