The law society of Kenya president Nelson Havi has revealed the most damaging and egregious assault to the constitution by president Uhuru. According to the lawyer, the head of state intends to effect seventy four alterations which is the highest ever in the world.He claimed that both former presidents Jomo Kenyatta and Daniel Moi only made thirty eight changes over the period of forty years that they were in power. So far, the intended changes have been declared unconstitutional by the high court but they have mobilised a battery of lawyers to appeal. Senior lawyers including James Orengo,Githu Muigai and Otiende Amolo are the latest entrants in the battle to overturn the ruling on the BBI bill.The LSK boss went ahead and recalled how the government of president Mwai Kibaki tried to force the changes in 2004. However,they were quashed by Justice Ringera who ruled that they compromise the basic structure of the original constitution hence unlawful.He argued that the high court findings that the president can't commence a popular amendment intiative were not new as they are some of the clauses which can't be amended. However, the BBI proponents argue that it wasn't the president who commenced them hence the court errored. They insist that MP Junet Mohammed and Dennis Waweru were the architectures of the whole process.
