The minority party questioned the haste with which the PS was reviewed and approved, but Kenya's Kwanza party, led by majority leader Kimani Ichungwa, rejected the move, saying the government needed their services in its ministries.
"We did it very quickly because each committee took the time to interview candidates,” Ichungwa said.
The PS review was delayed at the request of the Kenya Bar Association, but the court rejected it because it was obtained in a hurry.
The Law Society of Kenya (LSK) has asked the court to block the case in Parliament.
