Former Chief Justice Dr Willy Mutunga has reacted after a request by Director of Public Prosecution DPP Noordin Haji to have media barred in a court proceedings involving Kirinyaga county boss Anne Mumbi Waiguru was quashed.
In a case where Anne Waiguru is a witness of a case about the 791 Million National Youth Service NYS scam, the DPP had filed a request for media to be barred when Waiguru makes her presentation arguing that it was due to COVID-19 social distancing rules and the fear of Waiguru being misinterpreted.
The Nairobi Court however declined the application arguing that it will be unfortunate unrealistic to keep media away from such a case which was of public interest and instead promised to entire the COVID-19 social distancing rule is adhered to.
CJ Mutunga has on his part wondered about the application by the DPP to bar media from covering a court proceedings.
According to Mutunga the application by Noordin Haji was unrealistic and was not found anywhere near Kenyan constitution.
"What were the constitutional and legal grounds of such application, I wonder!" Willy Mutunga reacted.
