The case has been dismissed after the judge found that the David Were and the Orange Democratic Movement party did not present enough evidence challenging Nabulindo's win.
Nabulindo was declared the winner in the hotly contested by-elections held in the month of March this year after garnering 14,679 votes to trounce his closest challenger, David Were of ODM, who had 10,500 votes.
ODM however went ahead to file case alleging that the election process was manipulated and that Nabulindo did not win fairly.
The seat felt vacant after the death of ANC MP Murunga, ODM was determined to stamp its authority in the region by winning the seat, this however did not materialize. It is a very big win for Mudavadi who is seeking to consolidate Western Kenya votes ahead of 2022.
