"Save Your Extreme Positivist Learning" Ahmednassir Message To Havi

The President of the Court of Appeal, Justice William Ouko today received a final report from the chair of the Court of Appeal Committee on Electronic Case Management Practice Directions, Justice Gatembu Kairu. The committee Secretary, Benjamin Kinuthia was also part of the team.

The Court of Appeal has pro-actively adopted various Information and Communication Technology measures, such as e-Filing and virtual court hearings that have ensured the safety of Judges, the staff and court users during the Covid-19 pandemic while guaranteeing reliable access to services offered in the courts.

However, Ahmedbassir reacted to this. In his remarks he claimed that this is the only court that acts diligently, competently and with integrity unlike the Supreme Court. He added that Justice Ouko and his judges work hard and with distinction. He directed his claims to Have, professor Tom Ojiende, Dr. Kangara and even the Law Society of Kenya.

His remarks attracted the wrath of Kenyans and some told him that the Supreme Court appears to be competent when it suits him. They said that when it is upholding presidential elections and accepting bribes it is competent for him, but when it strikes out on his poorly presented cases and rejects bribes then it becomes incompetent for him. They dared that he must know that the Supreme Court is owned by Kenyans and not him.

Others told him that he should save his extreme positivist leanings. They told him that they agree that the Court of Appeal has the finest judges.
