I am not changing my views on the judgment made on defiling of a 13 year old girl,Justice said Chitembwe.
The 54 years old Chitembwe,stirred controversy in 2016 when he set free man serving a 20 year jail term for defiling a 13 year old girl free on grounds that it was wrong to hard the man the heavy punishment when both were enjoying the relationship.
He was the first candidate to be interviewed by the Judicial Service Commission for the position of chief justice and seventh Judge of Supreme Court.
The high court Judge defended judgment made ,urging the public not to use moderate words when describing sensitive societal issues.
Chitembwe added that he is not advocate of the reduction of the age of consent, he said in other judgment he tried to explain how in other countries the age is 14.
Justice Chitembwe said the broader matter is the social aspect of the law,which is meant to serve the people.
JSC commissioner Justice David Majanja questioned Chitembwe on the judgment writing and whether he thinks the ruling made already marginalized people fill left out in the justice system.
In the 2016 ruling,Chitembwe said the country should think of changing the age of consent to avoid jailing those who have sexual relationship with girls aged below 18 .
It was a decision that attracted international attention from womens rights organizations and was awarded Women Link World Wide Golden Bludgeon as the world worst ruling for women's right in 2016.
