After the High Court declared the BBI bill and the process illegal and unconstutionall, the architects of the Bill immediately declared that they will file an appeal in the Court of Appeal. The Attorney General Kihara Kariuki through the Solicitor General Kennedy Ogeto prepared an appeal which has been granted by the Appeal Court.
The Junet Mohammed and Denis Waweru led team already named a list of top legal minds that will be leading them in the appeal, including Lawyer Kennedy Ogeto, James Orengo, Paul Mwangi and Githu Mwigai. The Court of Appeal, labelling the appeal as urgent has now set the date of the hearing as 26th May, 2021.
Activists like the Linda Katiba under Martha Karua and economists like David Ndii had filed a petition challenging the legality of the BBI process, which was upheld by the 5-Bench judge High Court declaration.
Lawyers Waikwa Wanyoike are among those who will be compelling the Court of Appeal to uphold the High Court ruling when the petition starts on 26th May.
