Just moments after the High Court Judge George Odunga declared the Minimum Tax Provision unconstitutional and the minimum tax guidelines void, NTV Journalist, James Smart has gone to his twiiter handle to post: “Minimum tax provisions UNCONSTITUTIONAL. This Government will certainly survive, the next Government might just COLLAPSE under the crushing weight of 10-years of madness."
According to the journalist, the next Government must comprise of Leaders who he called “Mature" to get Kenyans out of the current situation “Madness." James Smart then posted “It's simple really. The next government will have to be a government of GROWN UPs because it has to make very hard decisions from DAY ONE that wouldn't be popular. They have a 0.1% wiggling chance with the economy."
This comes after the High Court Judge George Odunga issued conservatory orders restraining the Second Respondent, Kenya Revenue Authority, KRA whether acting jointly or severally from the implementation or further implementation, administration, application and or enforcement of Section 12D of the Income Tax Act, Chapter 470 of the Laws of Kenya as amended by the Tax Laws (Amendment) (No.2) Act, 2020 by collecting and/or demanding payment of the Minimum Tax pending the hearing and determination of this Petition.
