As JSC receives application for the post of CJ,it was shock to them as the Judges of supreme court failed to apply.To make matters worse the acting CJ who is DCJ Philomen Mwilu equally didn't apply.Kenyans have been having concern why the well known professor Makau did not appear on the list.Prof. Makau has break his silence when he said he has received messages why didn't apply for CJs position.According to him he had more reflection on the past CJs experience with the ruling party.He disclosed that is not possible to be both an independent and effective CJ
Makau said"I’ve been asked why I didn’t apply for the position of Chief Justice. After much reflection, I concluded that as the experience of the last two recent CJs strongly demonstrates, it’s not possible to be BOTH an INDEPENDENT and EFFECTIVE CJ in Kenya.
