According to lawyers representing Uhuru Kenyatta at the court of appeal, BBI is a document of the people of Kenya who are free to choose their destiny. The lawyers opine that the ruling of the High Court of Kenya as based on activism and personal vendetta hence biased.
The lawyers have cited a case in point where the judges ruled that Uhuru Kenyatta van be sued in his personal capacity yet he was himself not a defendant. It's a matter they argue was only done in activism hence biased from the word go.
The lawyers have vowed to separate facts from fictions and show the whole world why they believe High Court of Kenya ruling was anti-constitutional for many of the rulings that were done by court were not sought of by parties.
According to the lawyers Uhuru Kenyatta cannot be sued in his personal capacity for he is discharging national duties. They believe the president is immune from any form of prosecution for he is in office as president.
