Nick Mwendwa, FKF Dealt Another Blow By the Court

Former Football Kenya Federation (FKF) president Nick Mwendwa and the disbanded FKF have been dealt another blow after the court dismissed their petition.

The FKF and Mwendwa had filed a petition questioning the legality of CS Amina’s decision to to remove them and form a Caretaker Committee.

They had also put in an application under Certificate of Urgency seeking to have that decision (to appoint the caretaker committee) stayed pending the hearing and determination of their Petition number E473 of 2021.

The Court had on 25th of November, 2021 directed that the decision on the application for interim orders would be rendered on 16th December.

Unexpectedly, the court summoned counsels Dr both parties on Monday, December 6 and asked them to appear in court on Tuesday 7th where the ruling was made.

The Court has noted that while preparing its decision on whether to grant interim orders or not, any decision at the interlocutory stage would render the petition futile.

The court has, therefore, declined to grant interim orders noting that the legality of CS Amina's actions can only be scrutinised once the petition is fully canvassed or both parties are heard.

In the meantime, the Criminal Case file against Nick Mwendwa is up for mention sometimes next week.
