On Thursday, a middle-aged woman from Embu acknowledged murdering her husband on July 18, 2021. Following a drunken altercation, Elizabeth Wawira allegedly fatally stabbed Ngari Mbaka at their Ngiori Village house in Mbeere South. Mbaka died a few days after receiving treatment at the Embu Level 5 Hospital. Wawira has previously denied killing her husband. However, she informed the court on Thursday that she wished to change her plea, claiming that she had reached a negotiated arrangement with the prosecution.
The defendant told Embu High Court judge Lucy Njuguna that she did not plan to kill her partner and that she stabbed him accidentally during a domestic argument. Wawira claimed she and Mbaka were both inebriated at the time of the altercation. "My spouse arrived home at 9:30 p.m. on that day. For dinner, he handed me a few tomatoes and some sausage. A fight broke out between us as I was cooking the meat," Wawira explained. She stabbed Mbaka in the abdomen during the commotion. Mbaka's brother rescued him and transported him to the Embu Level 5 Hospital for treatment. However, the person died while seeking treatment. Mbaka died of injuries to the abdomen, according to the autopsy.
According to the prosecution, which was led by Leah Mati, Wawira was seeking a noncustodial sentence. Muthoni Ndeke, the accused's lawyer, informed Justice Lucy Njuguna that her client was sorry. Ndeke requested a compassionate punishment for Wawira, claiming that the defendant is her family's sole breadwinner and that her two children, ages 17 and 10, have suffered since she was arrested. Prior to the December 6, 2021 hearing, Justice Njuguna ordered that a pre-sentencing report be created and presented to the court.
