50-Year-Old Man Sentenced To Life In Prison For Marrying A 10-Year-Old Girl & Impregnating Her

Spirit of the Law vs. the Letter of the Law - Meaning and the Difference

•A fifty-year-old man was given a life term in jail by a Narok court after pleading guilty to defiling and marrying a ten-year-old girl.

•Saigulu Ololosereka was accused of defiling a 10-year-old child and illegally married her in 2019. He appeared before Narok Senior Resident Magistrate Phyllis Shinyanda.

•After pleading guilty to the charges, Ms Shinyanda wrote in her judgment that the man had been informed of the seriousness of the situation.

•Nevertheless, he insisted that he had married the girl because her parents had given her to him for marriage.

•Shinyanda continued by claiming that the victim had to face three years of misery as a result of the terrible and barbaric nature of the crime.

•The Senior Magistrate continued by stating that the young woman suffered female genital mutilation prior to marriage and afterwards underwent a caesarian section during childbirth, indicating that the horrific conduct had a long-term physiological and physical impact.

•She noted that the accused individual showed no remorse after being informed of the seriousness of the conduct. He claimed, though, that the young woman was his wife, whom he had wed three years before.

•The magistrate emphasized as she pronounced the sentence that she had taken into account the girl's age, the fact that she was also pregnant and the fact that the guy had been defiling the child for the previous three years.

•She claimed that the verdict will dissuade potential offenders. She gave Ololosereka two concurrent sentences of life in jail for the first offence of defilement and three years for the second offence of early marriage.

•Given the seriousness of the violation, state prosecutor Tito Wanga expressed pleased with the decision. The accuser has 14 days to file an appeal.
