Some months back, the Supreme Court of Kenya sealed the fate of the National Government Constituency Development Fund (NGCDF). In their statement, the court said that the Act, which was enacted in 2013 and changed in 2015, was unconstitutional.
According to this report that was penend down by a bench of five judges led by Chief Justice Martha Koome, the CDF Act violates the principle of separation of powers, and is therefore, considered unconstitutional.
Following the verdict that was made, parents have been having lots of worries over their school fees. CDF program has been in practice for over the past years. According to the program, a constituency is entitled to at least Sh100 million every year and the legislators have used the kitty for community development projects.
"A fund directed at service delivery mandate can only be constitutionally complaint if structured in a manner that does not entangle members of Legislative bodies and Legislative bodies in the discharge of the service delivery mandate however symbolic. " The team of judges led by Justice Koome, said.
This move to declare CDF unconstitutional is a big blow to the Parents, School Principals and the Members of the Parliament as well. Most MPs used these funds to build schools and sponsor needy students. On the other hand, parents depend on these funds for school fees purposes. It is therefore, becoming a challenge to this group of Learners and parents.
With the current increase in school fees and the tough economy, parents are even going to find it more worse if CDF won't be there totally.
Advise on how to Acquire These CDF Funds.
Don't sit back and relax, saying that CDF funds aren't there or else your child might not finish his/her studies. To continue getting these funds, approach your politicians, those whom you elected, and discuss with them your situation. They must be having an alternative way to handle this situation. They are also human beings and are ready to listen. I have seen a few individuals succeed through this in my village. Try your luck!
