This made the family members to exhume the body of their 96-year-old grandfather and take it back to the hospital mortuary awaiting court order.
The body of the nonagenarian had been lying in the morgue for three months due to land dispute between the deceased and his late brother’s sons.
On Friday a court in Nandi issued the legal directive after two people filed an application seeking to bar a relative the family members of the deceased from burying the old man on the disputed piece of land.
According to court papers, the deceased inherited the land from his late brother without the consent of the complainants.
Through the complainants lawyer, the applicants claimed that if the defendant went ahead with the burial ceremony, it will be against their late father's will as they argued that they are rightful beneficiaries of the land in dispute.
The matter is scheduled for mention in court next week Wednesday.
