The court of appeal has upheld a 20-year sentence for a man who was found guilty of defiling, impregnating and forcing a 15-year-old girl to do an abortion after impregnating her.
Kunona Kinyaga who is a boda boda rider broke the law by defiling the minor on different dates betweenJuly 1 and July 31, 2013, in Laikipia County.
The judges, Justice Daniel Musinga, Roselyn Nambuye and Sankale ole Kantai were satisfied and declared the evidence enough to give the rulling for his sentencing.
“We find no merit in this appeal. It is dismissed in its entirety,” ordered the judges.At the magistrate court during the trial, the prosecution told the court that Kinyaga had asked the minor who is a Standard Eight candidate to be his girlfriend and promised to marry her after she completes her primary school education. Kinyaga would visit the minor on several occasions at her home in the night hours. They made love several times until August 2013 when the girl got pregnant.
