The Attorney General caught many people by surprise, when he moved to court to withdraw the appeal he had filed against the ruling against the BBI document.
But today, the Attorney General has been taken to court by the rest of the BBI team that were filing for the appeal, after making the decision without informing them.
The Attorney General is being asked to clarify who is going to refund the amount that was paid while filing of the appeal, as they claim that even date for the hearing was being set.
The motion for appeal was file under urgency, and it was set for 21 of this month, and the move by the Attorney General must have caught many people by surprise.
The issue was even shared by Dennis Itumbu who tweeted; Lawyers involved in the BBI constitutional case write to court protesting that the AG cannot withdraw Application of Stay without leaving of the Court and Costs. Interesting.
Below is the letter addressed to the courts seeking clarification on the way forward with the appeal and the fee to be refunded.
