Judge Odunga of Machakos High Court has finally ruled on the case that included a Kenyatta University lecturer, Dr. Joshua Mulinge Itumo and Bash Hauliers Limited. The lecturer had petitioned in court seeking compensation of her spouse, Damaris Nduku whom he lost due to a road accident 10 years ago.
Judge George Odunga ordered the Bash Hauliers limited firm to compensate the lecturer Ksh 6,052,865 million for compensation.
Justice Odunga ruled that the driver of the company’s trailer, Faraj Said, and Kinyamasyo, who was driving his vehicle, were both liable for the accident that led to the death of Ms Nduku, who was a secondary deputy principal.
In his judgement, Kinyamasyo was more liable for the accident and he was to take the highest liability share. Judge Odunga found Faraj liable because he didn't try to reduce the impact of the accident by reducing speed.
They have been given a grace period of 14 days to appeal.
