Criminals In Arror And Kimwarer Dam Might Go Free After Worrying Details Of Case File Emerge

Milimani Law Court Judges lead by Justice Mrima failed to proceed with prosecution cases involving the managing Director of the Italian firm implicated in Arror and Kimwarer dams after the case file went missing. The loss of the case file forced the case that was set to be heard on Monday o be postponed until the case file is found.

Chief Magistrate Douglas Ogoti ruled yesterday the prosecution had failed to demonstrate how the two charges linked Mr Rotich to specific breaches under the procurement and public finance management laws. The case stems from an investigation into the misuse of funds in the two dam projects overseen by Italian construction company CMC Di Ravenna'

Mlimani Law Court Judge Mrima told the parties in the case to wait for more direction from the Court Registrar who will inform them when the case will be heard again when the file shall be found. Paolo Porcelli who is an important participant in Arror and Kimware case has asked the Court to quash an arrest warrant given by the anti-corruption commission.

Porcelli who united with other board members said in a document filed on October 1, indicated clearly that Director Oof Criminal Investigation Nordin Haji lacked enough evidence to prove the crimes.

"A close examination of the amended charge sheet indicates DPP does not have adequate evidence to prove a criminal violation. Charges levelled against us are vague and lacking clarity," they said.

The case was listed for mention on Monday, before Judge Anthony Mrima but failed because the file could not be traced.'

Porcelli said the Kerio Valley Development Authority(KVDA) and many government agencies could not show their ability in Arror and Kumaware Dams. He as well revealed that no land has been secured by Kerio Valley Development Authority for constriction.

"To date, no land has been secured by KVDA to begin construction, KVDA treasury and host of other government agencies struggled to address the issue," said Porcelli.
