Former Nairobi Governor Doctor Evans Kidero has been vindicated yet against after Trial Magistrate Douglas Ogoti of the Anti-Corruption Court dismissed a second attempt by the Directorate of Public Persecution to hold him accountable alongside Nyakach MP Joshua Owuor over a Sh68 million graft case.
According to K24, the court declined to consolidate funds amounting to Sh58 million in Evans Kideros's file, with Aduma been charged for illegally authorizing payment of ten million shillings to a law firm of a dead lawyer 8 years ago.
The magistrate truck the amended sheet stating that the DPP unlawfully tried to join the two cases.
“There is nowhere in the court record that the prosecution sought for the court’s permission to file the amended charge sheet. The charge sheet dated January 16, 2020, is hereby struck out, It is not open for prosecution or any other party to introduce documents to the record in a live matter without following due process.” said Ogoti.
