Confusion As Two Judges Exchange Controversial Judgements Infront Of Justice Musinga

The president of the court of Appeal Justice Musinga is presiding over the judgements of the building bridges initiative case that was heard in the last one-and-a-half month ago. After making his introductory remarks, Musinga said that he will offer an opportunity to every Judge in the bench to make their judgements according to their thinking and personal capacity.

Justice Francis Tuiyott and justice fatuma sichale have exchanged opposite judgements in front of justice musunga on the basis of the Quorum of the IEBC. Francis Tuiyott first argued that the IEBC did not have enough Quorum to conduct the verification of the signatures.

However Justice fatuma sichale made opposite judgement in which he said that the verification of signatures does not require Quorum of the IEBC officials. He argued that with three officials, the IEBC can carry out its mandate and therefore verifying of signatures does not require a policy of Quorum.
