The High Court of Kenya ruled out that there is no woman entitled to inherit a share of properties owned by the parents of her husband. Meanwhile the grandchildren, whose parents are dead, have a right to inherit the assets owned by their late grandparents.
The ruling came after a long period of a succession dispute in which a widow had lodged a protest seeking to inherit a share that her husband would have received from his father who died in 2010.
"In intestacy (where a property owner dies without a will) , whether under the Law of Succession Act or customary law, daughters-in-law are not entitled to a share in the estate of their dead parents-in-law, " Justice William Musyoka ruled.
In addition, Justice Musyoka said that even the sons-in-law are not allowed to inherit the estates of their parents-in-law as the Law of Succession Act has not addressed such claims anywhere.
