However, the DPP released Chivondo after he consented to a psychological evaluation to determine his mental health at Mathari mental hospital.
Chivondo first made headlines a month ago, when former Nairobi governor Mike Sonko paid for his release ,after he was fined Ksh100,000 for snatching products worth Ksh2,817 from a supermarket on Ronald Ngala Street.
According to the latest charge sheet, Chivondo was caught for the second time on May 19 for theft 5 litres of cooking oil and 5 kilograms of Pishori rice from the same supermarket, with a total value of Ksh 3,217.
Through a written agreement signed by the DPP and Chivondo's lawyer Viennna Mongare, the DPP dismissed the charges, citing the public interest in not prosecuting Chivondo.
The agreement adds, "After investigating the offenses and doing a background check, it appears that the public and your own best interests are served by not charging you."
Chivondo has pledged, under the terms of the agreement, not to violate any laws.
