The Meru High Court is set to hand down its ruling today dismissing the impeachment trial of Governor Kawira Mwangaza.
Mwangaza went to court last week to obtain an order barring members of the Municipal Council (MCA) from considering an impeachment motion against her.
Governor argued that 68 of her 69 MCAs signed the motion, which may not get a fair hearing from Congress.
Mwangaza further claimed, through her attorney Elias Mutuma, that the publication of the impeachment motion was summoned and signed by a stranger in the congregation who was serving as her secretary.
At a hearing on Monday, parliament, through lawyer Mutomi Teangkol, told the court that one agency cannot prevent another from exercising its powers.
He further argued that the final decision on the motion rests with the Senate, not Congress.
MCA intends to indict Mwangaza for gross misconduct, abuse of power and violation of law.
West MCA impeachment petition Dennis Kiogora is also serving as his Minority Chief Whip on Nov. 21.
