UPDATE: Possible Reason Why Attorney General has Opposed Court Suit Stopping Cherera Four Tribunal


The Attorney General (AG) has opposed a petition filed by three Meru residents to prevent a court investigation into the conduct of four IEBC officials during the August elections. 

 

The AG told Meru High Court Judge Edward Muriithi that the court, headed by Appellate Judge Agrey Muchelule, has strict time limits that can be compromised if the court intervenes. 

 

AG said, through attorney Karanjawachira, that the court will be one or the other in deciding whether to remove Julianna Cherera, Francis Wanderi, Irene Masit and Justus Nyangaya as her IEBC Commissioners. I said I have a month grace period. 

 

 

"The court's jurisdiction is only his 30 days. Therefore, if this court ceases court work, it will suspend the application of the Constitution," he argued in a preliminary objection. 


However, Mugambi Kiogora, an attorney representing the petitioners, said the four would face ill-treatment at the hands of the courts if allowed to exercise their powers. He argued that the four commissioners did not have a chance to defend themselves before parliament heard a motion to remove them. 

 

Kiogora said the matter being investigated by the court was finally dealt with by Kenya's Supreme Court during the presidential election petition. 

 

Petitioners say the four commissioners' trials are an unconstitutional "quirky and preordained charade" and want them to be dropped for the rule of law. Kiogora asked the court to hear the petition, arguing that the court hearing would be a parallel investigation into the same issues the Supreme Court decided. 


“The issue of impeachment of four interested parties was settled by the Supreme Court during the presidential campaign,” he said. "The petitioner has filed a complaint with this court for these violations. This court has jurisdiction under Article 165(3) of the Constitution on any question arising from this petition," he said. rice field.
